In these Terms, "we", "us", and "our" mean Online Logistics OÜ. "You" means you, the user of the Service.

• Service — the kinnisvarakuulutaja.ee website, related subdomains, mobile-web experience, APIs, and any feature operated under the brand.
• Account — your personal sign-in to the Service, created via email magic link or Google sign-in.
• Listing — a real-estate advertisement published through the Service.
• Seller — an Account holder who creates a Listing.
• Buyer — anyone who views Listings or contacts a Seller through the Service.
• Content — text, images, addresses, prices, video, files, comments, and any other material you submit to the Service.
• Inquiry — a message a Buyer sends to a Seller through the Service.
• Trader — any Seller who is acting in the course of a business, profession, or trade (as opposed to a private individual selling their own home).

By creating an Account, publishing a Listing, sending an Inquiry, or otherwise using the Service you confirm that:

• you are at least 18 years old;
• you have the legal capacity to enter into a binding agreement;
• if you act on behalf of a company or another person, you have the authority to bind them; and
• you accept these Terms and our Privacy Policy.

If you do not accept these Terms, do not use the Service.

You can create an Account using an email magic link or Google sign-in. You agree to:

• provide accurate and current information;
• keep your Account credentials confidential;
• be responsible for all activity that takes place through your Account; and
• maintain only one Account at a time.

You must notify us at info@kinnisvarakuulutaja.ee without undue delay if you suspect unauthorised access.

The Service is a self-service classifieds platform. It lets private owners and authorised representatives publish real-estate Listings and receive direct messages from Buyers.

The Service is not:

• a real-estate broker, agent, or intermediary in any sale or rental transaction;
• a notary, lawyer, lender, mortgage broker, escrow provider, or appraiser;
• a payment processor;
• a party to any contract that may be formed between a Seller and a Buyer.

We do not negotiate, hold money, transfer property, sign contracts, or guarantee any outcome of any introduction made through the Service. Any agreement reached between a Seller and a Buyer is between them only.

If you publish a Listing, you confirm and agree that:

• you own the property or have a current and provable right to sell or rent it on the owner's behalf;
• the information you publish (title, description, address, area, rooms, year built, price, photos, condition, availability) is accurate, current, and not misleading;
• prices are in EUR and include all components you are required by law to disclose;
• you have the right to use every photograph and other piece of Content you upload, and the Content does not infringe anyone else's intellectual property, privacy, or other rights;
• you will update or remove the Listing without undue delay if it is no longer available, the price changes, or any material fact changes;
• you comply with all applicable laws, including Estonian tax law, anti-money-laundering law, the Equal Treatment Act (Võrdse kohtlemise seadus), and all rules against discriminatory advertising;
• if you are a Trader, you self-identify as a Trader inside the Listing or in your Account, because different consumer-protection rules apply to Traders;
• you are responsible for handling Buyer Inquiry data (name, email, phone, message) lawfully — see Section 7;
• you do not publish duplicate Listings for the same property at the same time.

You are solely responsible for the legal and factual content of your Listing and for any communications you have with Buyers.

When you contact a Seller you agree to:

• act in good faith and only with a genuine interest in the Listing;
• verify all information about the property independently before signing anything or transferring money;
• never use Inquiry contact details for any purpose other than that one Listing;
• never copy, scrape, resell, syndicate, redistribute, or use any Listing or contact data for marketing, lead-generation, or training of automated systems.

If you are a Seller and you receive an Inquiry, you become an independent data controller of that Buyer's personal data. You agree to:

• use the Buyer's data only to respond to that specific Inquiry;
• not add the Buyer to mailing lists, CRM systems, or marketing audiences without the Buyer's separate, freely-given consent;
• delete the Inquiry data once it is no longer needed for the conversation;
• comply with the General Data Protection Regulation (GDPR) and Estonian data-protection law in all your processing of Buyer data.

We may suspend or close your Account if we believe you are misusing Inquiry data.

You keep all ownership rights in Content you submit. You grant Online Logistics OÜ a non-exclusive, royalty-free, worldwide, sublicensable licence to host, store, cache, reproduce, reformat, resize, compress, watermark, machine-translate, display, distribute, and promote your Content for the purpose of operating, securing, marketing, and improving the Service. This licence ends when you remove the Content or close your Account, except that we may keep:

• technical backup copies for up to 90 days; and
• audit-log copies that legally must be retained.

You confirm that:

• you own or have all necessary rights to grant this licence;
• the Content does not infringe any third-party intellectual-property right, privacy right, image right, or contractual obligation;
• if any individual is identifiable in the Content (face, license plate, unique address detail, signage), you have the right to publish that information; and
• the Content is not unlawful, defamatory, deceptive, harmful, or in breach of these Terms.

You agree to indemnify Online Logistics OÜ against any claim arising from your Content (see Section 17).

You agree not to:

• publish false, misleading, fraudulent, duplicate, or non-real-estate Listings;
• impersonate another person or entity, or misstate ownership;
• post Content that is unlawful, defamatory, hateful, discriminatory, threatening, sexually explicit, or otherwise inappropriate for a real-estate marketplace;
• use the Service for money laundering, sanctions evasion, fraud, or other illegal purposes;
• scrape, crawl, harvest, mirror, copy, index, or otherwise extract data from the Service except for the limited indexing that we explicitly permit through robots.txt;
• use any Listing, Inquiry, or other Content to train an artificial-intelligence or machine-learning model without our prior written permission;
• access, probe, or test the Service's vulnerability without our prior written permission;
• interfere with, disable, or overload the Service or its underlying infrastructure;
• bypass any security, rate-limit, or access control;
• introduce malware, viruses, or harmful code;
• use the Service to send unsolicited messages, spam, or marketing material;
• create Accounts by automated means;
• resell, sublicense, rent, or otherwise commercialise access to the Service.

We may, at our discretion and at any time:

• review, moderate, edit visibility of, hide, downrank, or remove any Listing or other Content;
• refuse to publish a Listing;
• suspend, restrict, or close any Account;
• require the Seller to amend a Listing before publication or as a condition of remaining live.

We will give the affected user reasonable notice when this is practical, but we are not required to give notice when:

• the Content appears unlawful, fraudulent, or harmful;
• a delay would expose users or third parties to risk;
• a court, public authority, or applicable law requires us to act; or
• the Account is being used in breach of these Terms.

We do not pre-screen every Listing. The fact that a Listing is visible does not mean we have endorsed it.

The base Listing for a private Seller is currently free. We may introduce paid features (for example: extended visibility, paid placement, additional Listings). When we do:

• we will publish the price and terms in advance;
• we will obtain your explicit confirmation before charging you;
• prices are in EUR and include VAT where applicable;
• we may use payment processors whose own terms apply to the payment transaction.

For paid digital features, you agree that performance begins immediately upon your confirmation, and that — to the extent permitted by Estonian and EU consumer-protection law — your right of withdrawal under §53(4) of the Law of Obligations Act ends once delivery has begun with your express consent. Refund rules will be published when paid features go live and will at all times respect your mandatory consumer rights.

The Service relies on third-party providers, including (without limitation): Vercel for hosting, Neon for the database, Cloudflare for image storage and content delivery, Resend for transactional email, Google for sign-in, machine translation, analytics and search-console reporting, MapLibre for map rendering, and the Estonian Land Board (Maa-amet) for map tiles and public statistics. Their use is described in the Privacy Policy.

The Service may contain links to third-party websites. We do not control those websites and are not responsible for their content, availability, or terms.

The Service — including its software, source code, design, layout, branding, name, logo, text, and graphics that we created or licensed — is owned by Online Logistics OÜ or its licensors and is protected by intellectual-property law.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, reverse-engineer, distribute, sell, or create derivative works of the Service without our prior written permission.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted operation, or freedom from error or harmful components.

We do not warrant that:

• any Listing is accurate or genuine;
• any Buyer or Seller will perform any obligation;
• any property, title, or transaction is free from defect or dispute;
• the Service will meet your requirements;
• the Service will be uninterrupted, timely, secure, or error-free.

Nothing in this section limits any warranty that cannot be excluded under Estonian or EU law.

To the maximum extent permitted by law:

• Online Logistics OÜ is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, goodwill, opportunity, or anticipated savings, however arising;
• Online Logistics OÜ is not a party to any sale, rental, or other contract between a Seller and a Buyer, and is not liable for any act or omission of a Seller, Buyer, or any third party;
• Online Logistics OÜ's total aggregate liability arising from or relating to the Service in any 12-month period is limited to the greater of (a) the total amounts you actually paid to Online Logistics OÜ for the Service in that 12-month period, or (b) one hundred euros (€100).

Nothing in this section excludes or limits liability that cannot be excluded under Estonian or EU law, including liability for death or personal injury caused by our negligence, for fraud, or for any matter for which mandatory consumer law forbids exclusion.

You agree to defend, indemnify, and hold harmless Online Logistics OÜ, its directors, employees, contractors, and agents from and against any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to:

• your use of the Service;
• your Content;
• your Listing or any transaction or attempted transaction with another user;
• your handling of Inquiry data;
• your breach of these Terms; or
• your violation of any law or any third-party right.

We may, at our own cost, take over the defence and control of any matter that you would otherwise be required to indemnify, in which case you agree to cooperate with us.

Our processing of personal data is described in our Privacy Policy at /privacy. By using the Service, you confirm you have read it.

You may close your Account at any time by writing to info@kinnisvarakuulutaja.ee. We will action a deletion request within 30 days, subject to retention obligations described in the Privacy Policy.

We may suspend or terminate your Account, and remove any of your Content, at any time and without prior notice if we reasonably believe you have breached these Terms, applicable law, or the rights of any other user or third party. We will give notice when reasonable.

On termination, sections that by their nature should survive — including 7 (Buyer obligations), 8 (Content licence — for Content already shared), 14 (IP), 15 (Disclaimer), 16 (Liability), 17 (Indemnity), 23 (Consumer rights), and 24 (Governing law) — survive.

We may update these Terms from time to time. Material changes — including changes to fees, data use, or your liability — will be notified at least 14 days before they take effect, by email to your Account email address or by an in-product banner. Non-material changes (clarifications, typos, contact details) take effect on publication.

The "Last updated" date at the top of the Terms always reflects the current version. Prior versions are kept on request.

If you continue to use the Service after a change takes effect, you are deemed to have accepted the change. If you do not accept, you should stop using the Service and may close your Account.

We may give you notices through the email address linked to your Account, through the Account interface, or through a banner on the Service. You may give us notice at info@kinnisvarakuulutaja.ee.

We are not liable for any delay or failure to perform that is caused by an event outside our reasonable control, including natural events, war, civil unrest, government action, sanctions, labour disputes, internet or hosting outages, denial-of-service attacks, or third-party provider failures.

• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions stay in effect.
• No waiver. Our failure to enforce any right does not waive it.
• Assignment. You may not assign or transfer your rights under these Terms. We may assign these Terms to any successor in connection with a reorganisation, merger, sale, or transfer of assets, with notice.
• Entire agreement. These Terms (together with the Privacy Policy and any feature-specific terms we publish) are the entire agreement between you and us regarding the Service and supersede any prior version.
• Language. The Estonian version of these Terms is the binding original. The English and Russian versions are provided for convenience.

Nothing in these Terms removes or restricts mandatory consumer rights you have under Estonian or EU law.

If you are a consumer and you have a dispute with us that you cannot resolve directly, you may contact:

• the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet, ttja.ee) — for consumer complaints;
• the Consumer Disputes Committee (Tarbijavaidluste komisjon) — for an out-of-court resolution; or
• the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Estonia, without regard to conflict-of-laws rules.

Disputes are subject to the exclusive jurisdiction of Harju County Court (Harju Maakohus) in Tallinn, Estonia, except that consumers retain the right to bring proceedings in the courts of their country of residence where mandatory EU consumer law allows.
